Acceptance of Terms
By engaging Teraju IP Sdn Bhd — whether through a consultation, an instruction to file, or any payment made in respect of our services — you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
These terms apply to all services provided by Teraju IP Sdn Bhd, including but not limited to patent searching, patent drafting, patent filing, trademark registration, copyright certification, and any advisory or consultancy services.
Fee & Payment Policy
All fees paid to Teraju IP Sdn Bhd are strictly non-refundable, regardless of the outcome of any application, consultation, or process.
This policy applies to all categories of fees, including but not limited to:
- check_circle Professional fees charged for consultations, novelty searches, drafting, and strategic advice
- check_circle Filing fees submitted to MyIPO or any international patent authority on your behalf
- check_circle Administrative costs, disbursements, and any other charges incurred in the course of service delivery
Clients are strongly encouraged to seek clarification on the full scope and cost of services prior to making any payment. Our team is available to answer all questions before you commit.
Scope of Services
We commit to delivering our services with professionalism, diligence, and the full depth of our expertise as former MyIPO examiners. The scope of each engagement will be agreed upon between both parties prior to commencement.
Any services outside the agreed scope — including additional claims, extra jurisdictions, or follow-up correspondence with examining authorities — may incur separate fees, which will be communicated and agreed upon before proceeding.
We strongly recommend all clients fully understand the nature, timeline, and cost of the service they are engaging before making payment. Our team is available to provide a detailed breakdown upon request.
No Guarantee of Outcome
While we apply the highest standards of professional practice to every matter we handle, the outcome of any intellectual property application — including approval, registration, or grant — is subject entirely to the discretion of the relevant authority, such as MyIPO or an international patent office.
Teraju IP Sdn Bhd does not and cannot guarantee any specific outcome. Approvals, rejections, and the timelines thereof are determined by the examining authority and are outside our direct control.
Our commitment is to prepare the strongest possible application on your behalf — drawing on our insider knowledge as former examiners — and to represent your interests professionally throughout the process.
Client Responsibilities
To enable us to deliver our services effectively, clients are responsible for:
- check_circle Providing accurate, complete, and timely disclosure of all information relevant to the invention or matter at hand
- check_circle Reviewing and approving all drafted documents within the timeframe agreed upon — delays caused by the client may affect filing deadlines
- check_circle Settling all fees in full prior to submission of any filing or commencement of drafting work
- check_circle Ensuring that the invention or work disclosed is genuinely owned by the client and does not infringe any third-party rights
Limitation of Liability
To the fullest extent permitted by applicable law, Teraju IP Sdn Bhd shall not be liable for any indirect, incidental, consequential, or special losses arising from the use of our services, including but not limited to loss of anticipated revenue, business opportunity, or competitive advantage.
Our total aggregate liability in connection with any engagement shall not exceed the total professional fees paid by the client in respect of that specific matter.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
